Terms & Conditions

1. Who we are
Scotflix is operated by Firewalker Pictures Limited, a company registered in Scotland under company number SC763880, whose registered office is at 25 Valleybank, Kilsyth, Glasgow, Scotland, G65 0RH (“Firewalker”, “we”, “us”, “our”).
You can contact us at maureen@firewalkerpictures.co.uk.
The Scotflix platform is provided using technology supplied by Hiway (UFLIX Ltd). Hiway provides the underlying platform; your contract for access to films and other content on Scotflix is with Firewalker Pictures Limited.
2. These terms
These Terms & Conditions (“Terms”) govern your use of the Scotflix website and services (the “Service”). By creating an account, renting or buying content, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Please also read our Privacy Policy and Cookie Policy, which explain how we handle your personal data.
3. Eligibility
You must be at least 18 years old to create an account or make a purchase. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian, who accepts responsibility for your use of it and for any charges.
Some content carries age ratings or content warnings. You are responsible for ensuring that content you access is appropriate for you and for anyone you allow to use your account.
4. Your account
You must give accurate information when you register and keep it up to date.
You are responsible for keeping your login details confidential and for all activity on your account. Do not share your password or let anyone else use your account. Tell us immediately at maureen@firewalkerpictures.co.uk if you believe your account has been accessed without your permission.
We may suspend or close your account if you breach these Terms, if we reasonably suspect fraudulent or unauthorised activity, or if we are required to do so by a rights holder or by law. When we do so, we will tell you why unless we are legally prevented from doing so, and we will refund any unused content you have paid for except where the closure follows your serious breach of clause 8.
5. Content, rentals and purchases
What you’re buying. When you rent or buy a title on Scotflix, you are buying a limited, personal, non-exclusive, non-transferable licence to stream that title for private, non-commercial viewing. You are not buying the film itself or any rights in it.
Rentals. Unless stated otherwise on the title’s page, a rental gives you 7 days to start watching. Once you press play, you have 48 hours to finish, and you can watch as many times as you like within that 48-hour window. If you do not start watching within 7 days, the rental expires and no refund is due, except as set out in clause 7.
Some titles may be offered on different terms. Where they are, the rental period and viewing window shown on that title’s page apply instead.
Purchases. A purchase gives you access to stream the title for as long as Scotflix continues to operate and we hold the rights to make it available. Licences do occasionally end. If a title you have purchased is withdrawn permanently, we will tell you and offer you a refund or a credit for it.
Availability and territory. Films on Scotflix are licensed territory by territory. Some titles may not be available where you are, and availability may change. We use your location to determine what we can show you.
Streaming only. Content is provided for streaming. Any offline or download feature, where offered, is temporary and tied to your account and device.
Quality. Playback quality depends on your device, browser and internet connection. We describe minimum requirements on the Service. We are not responsible for playback problems caused by your equipment or connection, but we will always help you troubleshoot.
6. Prices and payment
Prices are shown in pounds sterling (GBP) and include VAT where applicable. The price you see at checkout is the price you pay.
Payment is taken at the time of your order using our payment provider. We do not store your full card details.
If a title is listed at an obviously incorrect price and the error is one you could reasonably have spotted, we may cancel the order and refund you in full rather than supply at that price.
We may change our prices from time to time. Price changes never affect an order you have already placed.
7. Your right to cancel, and refunds
Your 14-day cancellation right, and how it works with instant streaming. For digital content supplied online, you normally have 14 days to change your mind. However, when you rent or buy a title and start watching straight away, you are asking us to begin supplying it immediately.
By clicking to play a rented or purchased title within the 14-day period, you expressly consent to us starting supply immediately and you acknowledge that you lose your right to cancel and receive a refund for that title. We will confirm this to you at checkout.
If you have bought or rented a title but have not started watching it, you may cancel within 14 days for a full refund. Email maureen@firewalkerpictures.co.uk with your order reference.
If something goes wrong. Nothing above affects your statutory rights. Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If a title is faulty - it won’t play, it’s the wrong film, the audio or subtitles are broken, or it’s materially not as described - tell us and we will repair or replace it. If we can’t, you are entitled to a full or partial refund. Contact us at maureen@firewalkerpictures.co.uk and we’ll deal with it promptly.
Refunds are made to your original payment method, normally within 14 days of us agreeing the refund.
8. Acceptable use and anti-piracy
You agree that you will not:
copy, record, download, rip, screen-capture, screen-record or otherwise reproduce any content on the Service, except any download function we expressly provide;
circumvent, remove or interfere with any digital rights management, watermarking, encryption, geo-restriction or other security or access-control technology;
re-transmit, broadcast, publicly perform, stream, share or make available any content to anyone else, including via screen-sharing, restreaming or file sharing;
use the Service for any commercial or public exhibition, including screenings in venues, businesses, schools, clubs or other public settings, without a separate written licence from us;
share, sell or transfer your account or login details, or use anyone else’s;
use bots, scrapers, crawlers or automated tools on the Service, or attempt to access it other than through the interfaces we provide;
probe, scan, overload or attempt to gain unauthorised access to the Service or its underlying systems;
upload or transmit anything unlawful, defamatory, abusive, obscene, or infringing of anyone’s rights;
misrepresent your location or use a VPN, proxy or similar to access content not licensed in your territory.
Unauthorised copying or redistribution of films is copyright infringement and may be a criminal offence. We and the rights holders whose work appears on Scotflix actively monitor for it. Content on the Service may be watermarked so that leaked copies can be traced to the account they came from.
If you breach this clause we may suspend or terminate your account immediately and without refund, and may report the matter to the rights holder and to law enforcement.
9. Intellectual property
Films and other content on Scotflix are owned by the filmmakers, producers, studios and other rights holders who licence them to us. Nothing in these Terms transfers any ownership or rights in that content to you.
The Scotflix name, logo, site design, text, graphics and software are owned by or licensed to Firewalker Pictures Limited or its technology providers. You may not use them without our written permission.
If you believe content on Scotflix infringes your rights, email maureen@firewalkerpictures.co.uk with details of the content, your rights in it and your contact details, and we will investigate promptly.
10. The Service itself
We aim to keep Scotflix available and working, but we do not guarantee uninterrupted access. We may need to suspend the Service for maintenance, upgrades, or reasons outside our control, and we will give notice where we reasonably can.
We may change, add to or remove features of the Service. Where a change materially reduces what you have already paid for, we will tell you and offer a refund or credit for the affected content.
We may withdraw titles when licences expire. Clause 5 explains what happens to purchases.
11. Our responsibility to you
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the Service and its content, including the right to receive digital content that is as described, of satisfactory quality, fit for purpose and supplied with reasonable care and skill.
We are not liable for business losses. The Service is supplied for domestic and private use. If you use it for any commercial or business purpose, we will have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
If defective digital content we have supplied damages a device or other digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation, as required by the Consumer Rights Act 2015.
12. Ending this agreement
You can close your account at any time from your account settings or by emailing us. Closing your account ends your access to any content you have purchased.
We may end this agreement and close your account by giving you reasonable notice, or immediately if you seriously breach these Terms (including clause 8). Where we end the agreement other than for your breach, we will refund you for any content you have paid for and can no longer access.
13. Changes to these Terms
We may update these Terms - for example to reflect changes in the law, in our services, or in how we operate.
If a change materially affects your rights, we will give you at least 30 days’ notice by email or an on-site notice before it takes effect. If you do not accept the change, you may close your account before it takes effect and we will refund you for any content you have paid for and can no longer access. Minor changes, such as correcting typographical errors or clarifying wording, take effect when posted.
Changes never apply retrospectively to orders you have already placed.
14. Complaints
If you are unhappy with anything about Scotflix, email us at maureen@firewalkerpictures.co.uk. We aim to acknowledge complaints within 2 working days and resolve them within 14 days.
If we cannot resolve your complaint, you may be able to refer it to an alternative dispute resolution provider or take the matter to court. Nothing in these Terms affects your right to do so.
15. Other important terms
Transfer. We may transfer our rights and obligations under these Terms to another organisation, and will tell you in writing if we do. You may not transfer your rights or your account to anyone else.
No third-party rights. This contract is between you and us. No one else has any rights to enforce it.
Severability. If a court finds any part of these Terms unlawful, the remaining paragraphs continue in force.
Delay is not waiver. If we do not insist that you do something you are required to do, or delay in taking action against you, that does not prevent us doing so later.
Events outside our control. We are not liable for failure or delay in performing our obligations caused by events outside our reasonable control, but we will take reasonable steps to minimise the effect and will refund you for content you have paid for and cannot access.
16. Governing law
These Terms are governed by the law of Scotland and you can bring legal proceedings in the Scottish courts. If you live in England or Wales, you may bring proceedings in either the Scottish or the English and Welsh courts. If you live in Northern Ireland, you may bring proceedings in either the Scottish or the Northern Irish courts.
